Bankman-Fried’s attorney has requested proper access to discovery documents and has asked that prosecutors not introduce any new evidence, and Judge Lewis Kaplan has ordered the government to reply.

On August 25, Sam Bankman-Fried will have his day in court to present his defense against the United States Department of Justice’s (DOJ) newly submitted evidence. Less than six weeks before his trial, which is set to begin on October 3, Bankman-Fried’s lawyers claim that an extra four million pages of discovery were provided.

On August 26, Judge Lewis Kaplan issued an order instructing the government to reply to Bankman-Fried’s legal team’s letters about Bankman-Fried’s proper access to discovery documents and a request to block the government from utilizing evidence obtained after July 1.

Lawyers for Bankman-Fried claim: “We also take issue with the Government’s recent creation of an extra 4 million pages of discovery. It is unacceptable to let the government six weeks before trial dump millions of pages on the defense. The Government should be barred from introducing any such evidence at trial for the reasons we’ve previously laid forth in our motions in limine, ECF No. 206.”

There are allegations that Bankman-Fried utilized user donations for his own personal gain, including investments and lifestyle costs, as well as political contributions. The two trials against the ex-FTX CEO will commence in October 2023 and March 2024, respectively, and will focus on a total of 12 criminal offenses.

Bankman-Fried’s lawyers claim that, owing to a shortage of vegan food alternatives, their client has been reduced to subsisting on bread, peanut butter, and water. His lawyer also voiced worry about his health, saying that he has not had access to his medicine since he was arrested.
